<p>After putting on the full-court press, a Florida foreclosure bill called HB 87 was able to pass the House committee. The proposal gives lenders just one year to pursue a judgment against a home owner if the sale of the foreclosed home doesn’t make-up what is still owed on their loan. Currently, the timeline gives lenders five years. The new bill also will require lenders to have all of their paperwork in order, including loan notes, when they file a foreclosure complaint. The bill was filed by Rep. Kathleen Passidomo, R-Naples.</p>
<p>She adds, “<em>We need to make the sure the process is as efficient as possible while at the same time giving the borrower their due process rights. Unfortunately, if you don’t have an income or you can’t afford to pay anything, the property can’t just sit in limbo forever</em>.”</p>
<p>Some consumer advocates say the bill brings about unfair changes for home owners who are already finding it difficult to defend themselves in the current foreclosure landscape. In South Florida, home foreclosures are on the rise once again, and advocates say this is a moderate form of the original proposal that will help speed up the process and clean-up the process.</p>
<p>The “faster foreclosures” proposal issues a variety of civil procedure changes that are specific to foreclosures in Florida. Currently, a Florida foreclosure can take more than 600 days to run its course, and proponents of the bill like Passidomo say it just can’t take that long anymore. The new bill brings about strict paperwork requirements for lenders and fast-track foreclosure procedures, and any backers say it couldn’t have come at a better time.</p>
<p>In Florida, foreclosure filings climbed 20% in the last year, and banks are getting ready to refocus on foreclosures once again after slowing down for about two years amid claims that bank employees improperly proceeded with foreclosure paperwork. The “robo-signing” scandal led to a landmark $25 billion national settlement between states and five major banks last year, clearing the way for a more streamlined foreclosure process.</p>
<p>Florida now has the highest foreclosure rate in the country, and despite the improvements in the housing market, experts say there are still plenty of foreclosures still to come. At present, one in five mortgages in Florida are delinquent, and over half of those have yet to enter the foreclosure process.</p>
<p>Passidomo is hopeful the new bill will speed things up. The original bill passed the Florida House last year, but died in the Senate. In the new bill, many of the controversial provisions, like the one allowing for faster foreclosure on homes that appear to be abandoned, have been scrapped.</p>

<p>For many South Florida home owners, the end of 2012 brought with it a tremendous amount of anxiety. There were looming fears that the Mortgage Forgiveness Debt Relief Act of 2007 wouldn’t be extended, and that sent sellers into a frenzy to close deals before the end of the year. Fortunately, however, the short sale tax relief act was extended for another year. The act allows borrowers to deduct their forgiven mortgage debt from their taxes after they have sold a South Florida home through a short sale channel, foreclosure or loan modification.</p>
<p>This is big news in South Florida where short sales have, and continue to, play a huge role in the nation’s economic and real estate recovery. Short sales are a transaction where a lender agrees to sell a home for less than what is owed on the mortgage. Threatened by the Fiscal Cliff deal, the tax deduction was set to expire on December 31, but was saved for another year.</p>
<p>South Florida home owners who are hoping to take advantage of this unique opportunity are encouraged to begin the process now while the majority of the year is still left in front of us. It’s unclear as to whether the Mortgage Forgiveness Debt Relief Act will be extended again, and experts say don’t expect it. Many short sale sellers found themselves scrambling at the end of the year to close their deals for fear of missing out, and while the extension is going to help a lot of people who were frenzied by the looming deadline, short sales do take a tremendous amount of time.</p>
<p>The 2007 law has been a huge asset to home owners pursuing short sales, foreclosures or loan modifications, and had it not been extended, home owners would once again have to claim the forgiven amount on their federal income taxes. Many experts speculate that short sales would have come to a screeching halt had the act not been extended, and the alternative could have been catastrophic to the economic and real estate recovery.</p>
<p>John Seebree, senior vice president of public policy at Florida Realtors, notes, &#8220;<em>It&#8217;s a major victory, especially for those who are in the process of buying right now. If you had a contract on a property and it didn&#8217;t close by December 31, and suddenly everything changed, that would be a difficult position to be in</em>.&#8221;</p>
<p>Close to 12,000 Florida real estate agents responded to a &#8220;call to action&#8221; from their trade group to contact congressional representatives and urge them to extend the tax deduction. It seems to have worked. Many agents say that while forgiven debt will always vary, they have seen it as high as $1 million. Owing that much on your federal income taxes could completely ruin a person’s financial situation, not to mention make it nearly impossible for them to ever purchase a home again.</p>
<p>The National Association of Realtors estimated the tax savings from the Mortgage Forgiveness Debt Relief Act topped $1 billion in 2011.</p>

<p>Following on from 2012, many believe that 2013 could also be the year of the short sale. There are an abundance of short sale programs designed to help Boca Raton home owners who are underwater in their current residence. These programs are set-up to streamline the process, and previous short sales that took nearly eight months to complete are closing in record time. Here are some tips to keep in mind if you’re considering a short sale for your Boca Raton home in 2013:</p>
<p>●     <strong>Understand Available Short Sale Incentive Programs: </strong>There are a variety of short sale incentive programs out there, and understanding them can take you far in this process. Here’s a snaphot:</p>
<p style="padding-left: 30px;">○     <strong>HAFA:</strong> Households that qualify for HAFA (which has both short sale and deed-in-lieu of foreclosure options) receive $3000 at closing. (Fannie Mae and Freddie Mac also participate in HAFA.)</p>
<p style="padding-left: 30px;">○     <strong>Bank of America Cooperative Program:</strong> In this program, qualified households that participate in this short sale program will receive $2500 at closing as well as relocation monies up to $35,000 if the borrower qualifies.</p>
<p style="padding-left: 30px;">○     <strong>Chase Bank (and Citi and SPS):</strong> Chase Bank is now sending certain borrowers letters offering them the option of participating in a short sale for a significant incentive (often between $20,000 and $48,000 dollars). Read the fine print on the offer and follow all of the rules in order to receive this incentive at closing.</p>
<p style="padding-left: 30px;">○     <strong>Wachovia:</strong> Wachovia Bank frequently sends borrowers letters asking them to participate in a short sale and offering an incentive in the letter. Sellers should read their mail and save the letter so that they can redeem the incentive at closing (usually between three and five thousand dollars).</p>
<p>●     <strong>Gather Your Short Sale Documents for the Listing Appointment:</strong> Prepared home owners will be taken more seriously in this process, and having all of your short sale documents together for your listing appointment will help streamline the process.</p>
<p>●     <strong>Prepare Your House: </strong>Order repair and pest control bids prior to submitting your short sale package to the lender.</p>
<p>●     <strong>Dot Your “I’s” and Cross Your “T’s”: </strong>Make sure the settlement statement that you submit to the bank has the correct figures for your closing date. Looking over all of this documentation carefully is crucial.</p>
<p>●     <strong>Protect Yourself: </strong>In this day and age, too many people are had by fraudulent lenders and practices. Do not use or accept electronic signatures when it comes to short selling a home. In this case, a good old fashioned signature should be a required item.</p>
<p>●     <strong>Communicate: </strong>One thing that can stall this process is a lack of communication, so stay in touch with all parties during the short sale process. Regular weekly communication is all you need. This includes following up with the lender(s) regularly.</p>

<p>While the real estate market as a whole has improved tremendously in South Florida, foreclosures are still a real issue and will continue to be during the first quarter of 2013. Should the region keep up with the current pace, South Florida could exceed 200,000 foreclosure-related repossessions in the first quarter.</p>
<p>In 2012, lenders repossessed or used the state court system to force the foreclosure of approximately 1% more properties than the previous year. To reverse that pace and return to pre-recession levels, the number of repossessions would need to drop by 350% to below 10,000 – about how many properties were seized in 2007.</p>
<p>Despite the spike in South Florida foreclosure actions, the 2012 total number of filings initiated in the region dropped compared to the same 12-month period in previous years. More than 57,600 actions were filed in 2010 and nearly 98,300 actions were filed in 2009. In previous years in South Florida, lenders repossessed nearly 30,500 properties in 2009, about 26,250 properties in 2008, and less than 10,100 properties in 2007, according to government records.</p>
<p>One unanswered question is whether or not lenders will continue to focus on alternative solutions to foreclosures such as loan modifications or short sales. Many lenders are operating under the recently negotiated National Mortgage Settlement Agreement tightening their latitude when it comes to enforcing the foreclosure process for borrowers who are in default.</p>
<p>In South Florida, distressed properties, which include bank-owned units and short sales, account for close to 14% of the nearly 19,400 condos and townhouses on the resale market. About 1,100 bank-owned South Florida condo and townhome units are currently on the resale market with a median asking price of approximately $85 per square foot in the Tri-County area.</p>
<p>“<em>In the last six years, foreclosure filings in South Florida increased rapidly between 2007 and 2009 before decreasing dramatically in 2010 and 2011 in response to the ‘robo-signer’ controversy. The year 2012 proved to be another year of increased foreclosure filing activity</em>.”</p>
<p>The “robo-signer’ controversy was administrative irregularities that first surfaced in late 2010. It created a foreclosure freeze with many lenders slowing the number of defaults being initiated against borrowers in South Florida between October and December 2010, according to the report.</p>
